His account wouldn't get banned for that.

Just make sure the key is a new one and isn't an used one. Keys cannot be used after they've been used once.

Don't buy a used game and don't buy from somone outside the country you live in. Product keys become tied to the account it is used on and can't be re-used. Steam isn't responsible if you buy from someone who isn't an authorized Steam reseller.

Only buy steam codes from eBay if you like giving strangers free money.

This seller lives in the U.S. And the code has not been used and or activated on a separate account also eBay as there money back guarantee should I still buy this item?

Software and/or digitally delivered goods are not covered by eBay's money back guarantee. It's also impossible for you to determine that key is in fact unused, until he gives it to you and you try to use it. Also, the sellers listed address on that eBay account is in the US. Which means absolutely nothing in regards to where the seller actually is. Nor is a good reputation, eBay accounts get hacked and abused too.

So I reiterate: only buy meaningless and valueless combinations of letters and numbers of eBay if you like giving random strangers money. Or the really old adage: If it's too good to be true, it probably isn't.
