If your OS is legal, you can exchange it to a 64bit version using the same product key.

If the game you want to play is 64bit then you need a 64bit OS. No way around it. Like Astraea Kisaragi already stated, if you own a legal Windows 32bit OS you can download a 64bit version on the microsoft page and install and activate it with the same key.
But you need to do a complete OS reinstall every time you want to change from 32 to 64 or vice versa.
But i would strongly suggest switching permanently to 64bit. Its 2016, most games that are released only use 64bit and 32bit has other restrictions.
All your old games will still run fine on 64bit if that is a concern.

The only problem is that the 64bit will ask for more ram then the 32bits one :D

Not really. The added overhead is minimal and the advantage of managing more than 4GB outweighs that "disadvantage" massively.
