Guide button doesn't display Big Picture Overlay

I am currently using a switch pro controller and everytime I try to use GUIDE to display the big picture overlay all I get is the activation sound but no overlay itself, however, if I press SHIFT+TAB I do get the overaly and the GUIDE button all that does is to display the options menu from big picture, it is NOT enabling the overlay, it does something else entirely, what the hell??

if I press the GUIDE button again while getting the overlay via SHIFT+TAB I do get back a good view of the game however all my controller and keyboard input is hijacked by the overlay that I just enabled via SHIFT+TAB, prompting me using that combo once again
