You can start up in Big picture mode by default when launching Steam, go into settings > interface > check the box to start in big picture mode, or uncheck if you don't want it to start up by default when launching Steam.
If you're using an Xbox controller, you can press the home button to launch the big picture mode after you launch Steam, if that what you want to do.
When in Big picture mode, you will be using the Big picture mode overlay, hence the Big picture mode.
I am saying that my Steam overlay is in big picture when using keyboard and mouse without a gamepad plugged in. I want Steam overlay in big picture mode when using a gamepad, but when i'm not using a gamepad, I don't want it in big picture mode (which it is in).
Sorry if I am not explaining things well, here is a simple diagram of how I want it:
Controller Connected > Big Picture Steam Overlay
Keyboard & Mouse Connected > Normal Steam Overlay
How it is now:
Controller Connected > Big Picture Steam Overlay
Keyboard & Mouse Connected > Big Picture Steam Overlay
Steam settings > In-Game > Uncheck the box for "Use the Big Picture Overlay when using Steam Input enabled controller from the desktop. This will use Steam overlay when you're not in BP mode, or launch the game in BP mode.
You still be able to launch BP mode with controller such as Xbox by clicking the Home button.
If you like, you can go to the suggestion, and idea forum, and put in a suggestion for adding an option settings to enable to have detect to switch between overlay whenever you plugin your controller, or unplug it.

That is the only way I have found to launch normal Steam overlay when using normal Steam even without a controller connected, but does that mean when I launch the overlay with a controller connected it won't be the BP mode overlay?
Far as I have been doing this as I always have my controller connected, or even replug it. I left the box uncheck it never brings up the BP overlay, but I normally just press shift tab since my KB is in front of me all the time.
Also to answer that question no it won't open the overlay when using the controller, you have to shift tab.
And when I do use a controller, I want it to bring up the BP overlay.
BUT if you're using home button from a controller u cant, for controllers only BPM works
