It is illegal in the case where the content in copyrighted and only paying users should see the content on the original source. Steam allows uploading screenshots, ot's your role to not upload copyrighted content.

But how do we know if it is copyrighted or not?

You are supposed to read the user agreement contract for each game, but realistically, nobody does, if you are just posting screenshots from your steam game on steam, you'll never get banned, if somehow, your content is copyrighted, you screenshot should be deleted. But don't fear sharing your highlights, I never seen someone getting in trouble for posting a screenshot.

Everything is copyrighted, but generic screenshots of games are generally condoned or even allowed through the EULA because it's free advertising. Nintendo has been a ♥♥♥♥ about youtube vids though.

It allows you to post content, but it won't check if it copyrighted/protected, it's your role

To be more exact a screenshot that is an image that is based on a players choices and actions making something happen that isn't hardcoded into the game is covered under fair use.

So a screenshot of a crazy pile of bodies in Hitman is protected under fair use but screenshots of images and text from a visual novel or telltale game isn't protected under fair use. Of course that doesn't mean those games makers are going to decide to purge those screenshots from existence just that if they did you wouldn't have the same protections other screenshots do.

Because like I said some screenshots are allowed and classed as the original creation of the person who took the screenshot.

The real question to ask is when Steam might be forced to remove the option from games where that type of screenshot can't be taken.
