To create an art is to live in symbiosis with the fact, that what is created, will exist for eternity beyond existence of any life form, above space and time, even if somehow the art could not exist anymore, the act of creation itself is still will exist forever.
Something being an art is not necessarily equal to being the good art.
I say games are art, some great, some not so great.
I may not know much about art but i know what i like.
I agree that games are pieces of art. But in real life I can't be bothered with art at all. This is not going to stop people who can appreciate it to appreciate it, just like even tho I can't care enough about my games being pieces of art this simple fact is not going to suddenly make it so or not.
