So long as the game was not being actively sold, the IP owners didn't care. (Most of the time)
With how Nintendo has been setting up it's own emulators on the Switch, that means the games are being sold which means use of the third party emulator is illegal.

If you're uploading something to the Steam Workshop, it has to be something you're allowed to distribute. If you upload something you don't have permission to distribute, that's a violation of not just the Steam Subscriber Agreement but also international law.
