If the emulator itself was illegal, Nintendo would've shut them down long ago.
In fact, there used to be a commercially sold PS1 emulator that Sony tried to sue the creator over. They lost because it was determined that emulation in itself wasn't illegal as long as no copyrighted code is being used.
So no, emulators aren't illegal. Acquisition of ROMs are if they are acquired a certain way.
