been thinking off getting back into the game after many years away just wondering if its still active or is it dead

There are still daily players, and voyages on the Notice Board under the Ye tab of the Sunshine Widget tab. Your best bet would be using or starting an Emerald pirate. The Galleries under Events will have one that goes to Admiral, which is the tartiest dock.

i already have a pirate and crew and flag on emerald just not played in years so just seeing if its still active before i go back into it

Game is not active, developers killed the entire game dark seas, "because they do what they want and ban who they want" they've even been sued for it, game is dead, game died because 100% ree ree developers who are hate crime developers.
