In Canada if you drink in public you have it taken away/dumped and get a ticket. If you're grossly intoxicated and are posing a risk to yourself or others you can be charged but most agencies and officers chose to arrest them just to hold in cells until they're safe and sober and then they'll be released without charge.
Looking at these US statutes, they say being drunk AND a danger to one self or others.
The drunk peds in the game aren't hurting themselves or others (yet).
even if they catch u with an open container in ur hand or vehicle they don’t care they will arrest u for it cause public intoxication is a crime and the officers care about safety of the people in that town and if u act disorderly towards them u will get arrested for disorderly conduct towards an officer
also any form of hitting a person or law enforcement official
either by open hand slap
closed hand punch or with an object
u will be arrested for battery
