I get not wanting to have a crime system, but it's a world of magic. There are lots of way better ways they could have implemented loot gathering.
The absolute bare minimum should be a quick comment when you take something: "You probably need that more than me", "Take that as a gift and good luck in your studies", etc

This is so true, even when you use dark spells or curses or whatever they're called. I think I heard one NPC say like "oh no don't use that". There's like no consequences or reactions to anything you do in the game.

Because open world games tend to create their own restrictions and when you try to be naughty, you have to try and not get caught? What you're defending is lazy design.
