My apologies, but Gandalf is from a completely DIFFERENT IP (intellectual property).
He is either no magican but a Maia, which are sort of "half-gods" in the world of LotR, even though "half-god" is quite a bad description, since it's far more complicated than that.
But I guess I rather describe it as that, as of you thinking it would be legit that he appears in this game.
Don't be silly. The Middle Earth and Harry Potter IPs are two utterly separate IPs and both are copyrighted to the max.
