Halo 3 Co-op assigning the wrong character

tried playing halo 3 co-op with a friend online, but for some reason no matter who hosted he was staying as chief, and i was stuck as the arbiter, we tried switching hosts, restarting, inviting at different times, reopening the game, and regardless of what happened i'd still end up playing as the arbiter even while being the host. if there's a fix i'd love to know because google and even searching the discussions here has been pretty useless

I don't know if this is purely coincidental or what, but as the one who always hosted the sessions, I was always Chief UNLESS I started at a rally point, which then assigned me as Arbiter.

i don't know exactly what was causing it, but even as host i was arbiter
