You can smacktalk all day long in XBL, but the distinction between "smacktalk" and homophobia, transphobia, racism, and invitations to violence is a wide, deep chasm that shouldn't need a great deal of definition.
That people seem to think it does speaks volumes about their behavior, not anyone else's.
Your proberly right :) banning someone is a loss of money with all said and done but if Microsoft decided to crack the whip so to say every xbox live member has agreed to the terms :)

No you can't talk trash talk because what you deem is trash another deems as harassment.
Anyone can report you if you step out of line, the more reports, the more likely a ban.
trashtalking is an insult wrapped in an exaggeration, some can use it as a form of humour but a counter-point to such humour is that it can be in such poor taste it can also be seen as a form of bullying another person as well. depends how serious the brick flies through the window in subtly to judge what must be done in response.
it can be seen differently from person to person who handles the case, but there is just no way scraping the barrel that hard isn't going to get you anything less than a hard looking into and evidence recorded of such behaviour should to get into it again, not to mention previous cases where you have had black marks recorded to your account.
Since you have already already have a black mark on your account OP, i doubt the people running the policing are going to let you off too many times, but that depends on them.
Pretty much this, also people can mass report you for nothing. When you bump into clans, I've sent messages to one player stating their high ping, I get multiple messages back then suddenly checking the https://enforcement.xbox.com/en-US/home/reputation site, suddenly I have had my cheating reports increased and also voice comms.
a) I don't cheat, b) I don't use a mic on XBL.
People abuse the reporting system, MS make it too easy to report someone and this obviously gets abused.
