Xbox Live Code Of Conduct
Ok so people say you can get banned from xbox live for trashtalking but thats really a myth.
I got a "communication ban" before on xbox for using the other F word in a text message but thats understandable. The ban did not prevent me from playing online it just made it so i could not use voice chat or send texts for a week.
I was told when i emailed them that trashtalking is not against the rules but sexist,homphobic slurs ect. were. With all the racist things people type in pc lobbies i imagine a lot of communications bans coming up.

Remember the days when you could say whatever the ♥♥♥♥ you wanted, insult someone's mom who had cancer and you'd get away with it?

Consequences
A violation of the Microsoft Code of Conduct may be cause for these or other actions:

Permanent suspension or device ban, if you try to avoid suspension with alternate accounts and/or devices.
Permanent suspension or device ban, if you repeatedly commit violations.
UPON RECEIVING A PERMANENT SUSPENSION, YOU FORFEIT ALL CONTENT LICENSES, GOLD MEMBERSHIP TIME, AND MICROSOFT ACCOUNT BALANCES ASSOCIATED WITH THE SUSPENDED ACCOUNT.

You can smacktalk all day long in XBL, but the distinction between "smacktalk" and homophobia, transphobia, racism, and invitations to violence is a wide, deep chasm that shouldn't need a great deal of definition.

That people seem to think it does speaks volumes about their behavior, not anyone else's.

Your proberly right :) banning someone is a loss of money with all said and done but if Microsoft decided to crack the whip so to say every xbox live member has agreed to the terms :)

I have friends on xbox who say the policy is complete ♥♥♥♥ as in they get banned cause they kill tkers in r6s and get reported saying they are trolling and targeted for harassment. The main reason the code of conduct is ♥♥♥♥♥♥♥♥ is cause its not applied correctly.

No you can't talk trash talk because what you deem is trash another deems as harassment.
Anyone can report you if you step out of line, the more reports, the more likely a ban.

smacktalk is no joke, the intention of such behaviour is being abusive to the point it is seen as bullying. Of course bullying is one of the lowest things a person can do to another, be it real life or on a computer screen. it is not acceptable behaviour.

trashtalking is an insult wrapped in an exaggeration, some can use it as a form of humour but a counter-point to such humour is that it can be in such poor taste it can also be seen as a form of bullying another person as well. depends how serious the brick flies through the window in subtly to judge what must be done in response.

it can be seen differently from person to person who handles the case, but there is just no way scraping the barrel that hard isn't going to get you anything less than a hard looking into and evidence recorded of such behaviour should to get into it again, not to mention previous cases where you have had black marks recorded to your account.

Since you have already already have a black mark on your account OP, i doubt the people running the policing are going to let you off too many times, but that depends on them.

sorry not perma bans it was temp com bans small things like that bro you could literally just curse in (xbox) chat and get temp com banned for someone reporting you and about the sportsmanlike conduct that really does nothing and is more of how fast you will get banned or if they will check. I just dont understand why they dont just go back to the good old days. Of all the ♥♥♥♥ talk i understand actual threats of violence but i dont get why someone should get temp banned for calling me the N WORD

Pretty much this, also people can mass report you for nothing. When you bump into clans, I've sent messages to one player stating their high ping, I get multiple messages back then suddenly checking the https://enforcement.xbox.com/en-US/home/reputation site, suddenly I have had my cheating reports increased and also voice comms.
a) I don't cheat, b) I don't use a mic on XBL.

People abuse the reporting system, MS make it too easy to report someone and this obviously gets abused.
