MK11 just took down the quartering's video over Jax's ending.
The quartering made a video about Jax's ending and it got shut down by MK11 devs.

Uh since when can you have videos taken down for "spoilers"

If it's about unreleased material that hasn't been sanctioned by WB then they absolutely have the right to under copyright grounds.

It actually falls under the fair use exception, you have no right to take some other's transformative work down even if you own the copyright to the material. That is the only way for journalism to be legal.

You're right, but it's also not relevant. The original question was "since when CAN you have videos taken down for spoilers." The laws and enforcement of laws around such things are a complete joke that do not have the best interests of the vast majority of people at heart.

We can cite fair use until we're blue in the face and the answer is still going to be "since forever."

See above. And there were plenty of MK11 leak vids taken down from Youtube. Dont act like this guy was specifically targeted because he wasn't.
The video in question, about the ending, was NOT taken down by WB/NRS. the uploader closed their youtube account (before you say it.. they were NOT banned either)

Only for published material. The clip falls under unpublished material and is exempt from that clause.

"The general standard, however, is clear enough: the fair use copier must copy no more than is reasonably necessary (not strictly necessary— room must be allowed for judgment, and judges must not police criticism with a heavy hand) to enable him to pursue an aim that the law recognizes as proper, in this case the aim of criticizing the copyrighted work effectively."

Fair USE in UNPUBLISHED WORKS

Because it's a spoiler of unreleased material. Pretty standard procedure.

You can't be serious.

Is your IQ in the single digits? It literally says that in the first sentence "Another big element in determining fair use is whether the work is PUBLISHED or not."

It's fun to participate in a forum full of experienced copyright attorneys.

It's how youtube works. 3 strikes, you're out. It's in their agreement. You like those. Go ahead and read them. The dude's livelihood comes from his channel, and he's now 1/3 of the way to having no way to pay his bills. Bit heavy-handed.

He broke the embargo , if he didn't broke the rules that strike would go away.

"Nevertheless, it is possible for use of unpublished materials to be legally fair under certain circumstances."

Silly they give just one example. But hey, you're the lawyer, right?
