Well, it is effected by your rule, just like spending wood tokens requires you to control a pathway from the wood tokens to the desired building location.
Now in this case, the game banner says you rule it (it's orange, not green or anything in between). However the lack of any actual units seems to be affecting the imaginary supply line between the two workshops.
Oh, that is an interesting suggestion. It might be a problem of programming logic: both Command Warren and the Cat's crafting happens "at the beginning of Daylight." Perhaps when both try to trigger at the same time, they interfere with each other?

I have 2 workshops in rabbit clearings but as the Marquise I can’t craft Better Burrow Banks or Command Warren.
