The War of the Worlds: Andromeda

Lets talk about copyright infringment
Lets explain some copyright rules.
The War of the Worlds in its original written form is now public domain you are free to make a game based on the book and no-one can do anything about it. You can have tripods and aliens in the game no problem...
HOWEVER if someone were to design a tripod lets say Steven Speilberg and use it in a film released in say 2005 then the visual appearance of that tripod is owned entirely by Steven Speilberg.
If someone else, lets call him rustythe1 were to make a recreation model of the visual nature of Steven Speilbergs 2005 films tripod then they would only be able to distribute it for free as fan art and even then Steven Speilberg actually has the rights to squash it out of existance if he chooses to.
If rustythe1 were to upload said model to a site like Turbosquid for example then it should have been listed as a free model not for commercial use. He cant sell it as its not his design and it cant be used in any product being sold for money.

Hopefully you can see what im saying here. By downloading rustythe1's model of a copyrighted 'character' from a blockbuster film made by a major film studio and implementing it into your game and charging money for it YOU ARE BREAKING THE LAW.

you need to either...
distribute your game for free as a fan made homage and hope paramount dont mind (see "stage 9" for a freely distributed fan art project that got killed by the the copyright holders)
or
not use the tripod you have used. that model is of near enough likeness to be an obvious copyright infringement.
if paramount or amblin were to find you have made this you would recieve a cease and desist in no time.

ive considered sending an email to paramount and see how long it takes for this game to disappear, im not that way inclined but maybe the next person to come across this abomination of a game will actually bother to shoot it down

The model used in the game is

https://sketchfab.com/models/b831a548dd8243c485d5822d9df6c3e6

With license https://creativecommons.org/licenses/by-sa/4.0/ that says:
You are free to:
Share — copy and redistribute the material in any medium or format
Adapt — remix, transform, and build upon the material
for any purpose, even COMMERCIALLY.

It has significant differences. Additionally we have introduced more significant differences that probably make it a non-derivative product, if you had bothered to notice that the model in the videogame, more different that previous, has legs and the turn of the head has nothing to do with the model of the 2005 film.

What I find embarrassing is that you come to this forum to threaten me. I will not have any problem changing the model if Paramount gives me a justified reason for having to remove it. The reality is that it will take me to change it very little.

Well, speaking about Copyright infringment we have detected that there are already a few pirated copies of our video game already on the internet. We will proceed to denounce one by one each of the sites, this work is protected by the intellectual property law of Spain and therefore of the European community EU. Exp. 09-RTPI-08144.3/2018

What is your vested interest in this holy crusade of yours and is it one of many crusades you embark upon or have you just singled out this one, for questionable motives?

Paramount is big enough and has a massive 'anti-infringement' division which is quite capable of dealing with any real IP infringement without needing what sounds like a 'tattletale' to help them. Hard to believe you would do this 'out of the goodness of your heart'. Is this an attempt to receive financial reward or some kind of satisfaction for being a '"Snitch"?

I have nothing to do with the developer and was also wondering about IP infringement but as I said, Paramount is fully capable of dealing with such without you getting involved in the manner you threaten.

And another locked profile!!!
