No matter how you launch the game, even if you launch it from VR in SteamVR, some games will still use the Oculus API in this case as well). The Oculus API does not support overlays from background apps and probably never will.

I'm not sure what setting you are talking about in OVR Advanced settings.
To give you an idea of how fpsVR detects that the game is using the Oculus API:
it sees that a non-SteamVR process is the current process that sends frames to Oculus. And at the same time, nothing happens in the SteamVR events. So the game connects to Oculus and sends frames there. And it doesn't connect to SteamVR. There can be no mistake in principle.
