An inconsistency in the ending scene

So I made a fresh run after the update, during which I paid attention to the story again, and something keeps bugging me...

Moved the spoilers to a reply as the mouseover ignores it.

Even though I shot Oberon to death at the end of chapter 5, the OMNI in the final scene speak of him as if he was still alive.

Now I get you can play both chapters independantly after completing the game, but there could be a variable that stores what you did the last time you finished chapter 5.
