Just don't try to sell the game without Nintendo's permission, of course. Copyright and all that.
I'm curious if that has ever worked out before, with getting permission and all that to sell something fanmade.
But I'd bet you Nintendo never has. Also monitization has nothing to do with it, if Nintento catches you making a fangame with rips/trademarked characters with enough exposure to get their attention even if you are in the hole and not making one red cent they will DMCA your ass faster than you can blink.
