Andre and Warrior are both dead and are being used with the legends agreements and both have payments made to relevant people. But Dalip Singh Rana is alive and works on match based contracts and has been used in games as much as the earlier WWE contract allows.

Matt Hardy is a 44 year old that has beat the hell out of his body for the last 28 years, he has 2 young kids, look at how far his home is from the WWE head offices where they do all of the creative stuff, and look at how many days on the road he would be doing if he stays with a show. or works a 5 day week in the offices. Looking at his past I dont think he is the kind of person that will be a 1 day a week parent.
Both the Hardy brothers have interests in other wrestling company's.

What about the fact that Matt Hardy had a house show match like a few days ago?
Now personally the word" is" rather than "has" means something, he has said he is retiring, which points to a date in the near future, I would say probably when his contract comes to an end, Finishing his career on good terms with the WWE will leave a nice open door to get onto the "Hall of Fame" in the future.
B) Matt Hardy has major medical issues going on including the fusing of his lower back and pelvis... this caused from all of the years of abuse he has taken. He is pretty much done with the exception of perhaps a few special appearances. I doubt we will see him in even 10 more matches. Word has it that he's been upset about the WWE screwing up his broken gimmick so badly as well. That being said he will almost certainly have a legends contract and be in the games for years to come.
