No you don't have to make sure your gear is leveled.
The game is not that difficult that a few points of armor make any difference. Upgrade every 5-10 levels or use epic gear that you find.
and now, you're talking like the you are in the hate bandwagon. This is my 2nd assassins creed game, I'm only a casual gamer.. I managed to reach lvl 79 now without grinding too much. The only thing that keeps me going is obtaining pegasus from that box.
I'm playing on nightmare and yes a common soldier can kill you in two or three hits, and try taking down enemy captains and mercs with weapons 5-10 levels lower then them. It takes about 10 minutes to get their HP bar down... Then when you go to upgrade that weapon you find it costs hundreds of every resource and thousands upon thousands of Drachmae. It's ♥♥♥♥♥♥♥ stupid.
Obviously the battles are about killing captains but guess what, the captain always has at least two or three normal guys backing him up, and every time you kill one he'll call for another to take his place.
In Odyssey, it is not supposed to work that way. You don't get overpowered just by leveling up, you get overpowered through your *abilities* and *gear*. Yes, it's true that with the default scaling, enemies' HP scales to your level, but if you have allocated your ability points smartly and you have good gear, you will notice that the amount of damage you do proportionally increases even as their HP increases.
For example, I'm 211 hours in on Hard difficulty (first playthrough) and I just finished the most recent DLC episode at level 72. I have the default level scaling on so most enemies are around that level too, but despite that, fights are much easier than they were 40 or even 20 levels ago. I have legendary daggers + the Minotaur's labrys with the Immortal armor set and +25% damage to elites and bosses as well as +25% poison damage and the reduced overpower cost of the labrys. Then throw in maxed out hero strike + fury of the bloodline + ring of pain and I absolutely dominate every single combat encounter. I think I've gotten like 2 desyncs in the past 20 hours of gameplay and that was only because the Immortal set ability doesn't work with fire damage.
Anyway the point is that you will become overpowered if you play the game right instead of trying to play it like Origins.
That just sounds like an issue with poor difficulty scaling between hard and nightmare, not an inherent flaw in the leveling system.
This post has some really great advice. Your enemies will continue to scale with you. You'll need to play with different abilities and engraving your weapons and armor to get an edge on them.
