Blue = Athenian
Red = Spartan
Black = Pirates/Bandits
Plain sail = Merchant/Civilian
Merchant ships have nothing of value anyway, military or pirate ships give more loot and resources. Trashing latter will not give you bounty.
By the way, only sinking ships is a crime. Leaving them stranded with zero hp is fine, just like leaving NPCs unconscious.
They kinda level up with you. I've seen some being like 2 or 3 levels below me and when I got way too ahead of them they leveled up too, keeping those 2 or 3 levels distance.
