If you can, pay of the bounty on the world map or try to kill the bounty sponsor.
And it has nothing to do with difficulty, even on Normal or Easy a mercenary that is a few levels higher then you will kick your behind to kingdom come.
I play on normal and I have no issue killing mercenaries who are 3 level above me. Maybe hard difficulty makes the enemies a lot tankier but with the right skills, they are totally manageable on normal.
Just avoid the random ones you see in the world, they won't attack you and will likely be higher level.
Mercenaries don't track you the bounty hunters do, mercenaries are passive until you attack them, also the mercenaries seem to be 2-4x harder than regular bounty hunters and have more health and dmg
ive been doing it all morning and also found out if you have tamed a wolf the dog can sometimes kill them before you manage to knock them out

I always assumed they were all mercenaries and the game sends the ones around your level to kill you.
The bounty hunter appears in the mercenaries window. The ones not sent to kill you belong to higher tiers.
