it may look similar but that's just how it works, popular vests or weapons are an inspiration for most items in fps games. models are usually made based on a reference, you can't expect devs to design new weapons/clothes just to use them once in a game especially when it's an indie studio.

Edit: Those black patches are typically velcro where a name tag would be placed.

It's all based off real life equipment in both cases. It's not a stolen asset.
there is, the dark spot is the place where you can put your signs on like police or the us flag for example, its a Velcro® fastener (i hope that is the right name for it in englisch) and it is very common on modern armor to have it on this spot.
