Gamepass version hardcapped at 44 fps

Trying the game on PC gamepass but the framerate caps out at 44 fps?

It says its running at 165 but it clearly is not, its not even hitting 60 for me.

The counter shows 75 fps (like a monitor), but in fact it’s about 30 by eye. Twitchy, uncomfortable, unplayable for me.
