Guards just wont yield sometimes

Let me start this off by saying i've played around 500+ hours of skyrim, I'm pretty experienced in this game so I don't really need an FAQ or something simple like that.

Occasionally when I am in combat with guards I will attempt to yield to them and they wont. This seems to be completely random. I am well aware that you need to sheathe your weapon, and that at a certain bounty they simply wont yield, this is not the question. I have searched for advice on this and those are the only responses people seem to give so I want to weed that out as fast as possible. I know you can leave town and come back, that's not what I'm asking for. It seems like a minor thing but I retire characters when they die so it becomes an issue that occasionally the guards will just wreck them in a couple seconds before I can run.

If there is a way to prevent this I would be extremely grateful. If there's a mod, I will download it. But I have found nothing.

Yeah, they do that. I have not found any specific mod either. Suggestions below are not what you are asking for, but maybe something you can use? I am using both mods myself.

Death Alternative - Your Money or Your Life by BralorMarr
DA has a crime event. If you "die" during combat with guards, then they will toss you in to prison to recover. Mod has plenty of other scenarios as well. I recommend setting it to Bleedout + Hardcore and using the hotfix. Ragdoll is buggy and easier difficulty levels usually just let you watch how your character crawls around, while preparing to get killed again.

For the option of just running. One of the guards will run after you, but telling him to go jump off the pier will stop that. After that, you can just run away from them and keep your head down, while your bounty goes down. Seeing that my characters are somewhat adept in prison breaks, this mod has saved me from a lot of trouble.
