Lurbuk won't die!!!

I'm doing the Dark Brotherhood missions and Lurbuk won't die. He gets on his knees and then stands up, I type kill in console and he stands right back up with no name!!! What do I do, I just did a hard save a quick save and all my auto saves are where he won't die. Help please!!!!! And yes I have the unnofficial patches.

If "Laid to Rest" is active, Lurbuk might be reserved for a raid to vampire lair. That might make him a temporarily essential character, altough this was never documented or conformed (at least as far as I know.)

If quest is not currently active, then I am currently out of clues. Lurbuk shouldn't be assosiated to any other quest than Dark Brotherhood contracts and Laid to Rest.
