By any chance are you using wearable lanterns and does your NPC have one?
It was just one of the mods I thought might be causing it at the time. If your follower didn't have one you should be fine using the mod.
Another mod I now recall that might have caused the problem was left hand rings, because my NPC was wearing two rings, a necklace, a cape, a lantern, and a sword with several magical staves in their inventory. I think their equip script went haywire trying to deal with all that stuff.
HD DLC, and unoffical skyrim patch, HD unoffical skyrim patch are all that is installed.
if i save and close skyrim, then start and load it clears it for me.
As for Left Hand Rings, the issue probably comes from inventory slots - The unreadied shield takes slot 60, and I believe LHR does the same.
I found out it was save game dependant - something happens to the save that makes the script references go out of whack, and it happens from then on, regardless of mods and mod order etc.
I loaded an earlier save, as well as a different character, and it was not present on them despite it appearing beyond fixing on my main save.
I made a new save game in a quiet place with no followers etc (no idea if this made a difference). I backed this up to a separate folder in case I stuffed up.
I then used Save Game Script Cleaner by Hadoram

I didn't bother reading all the instructions for it - my save game was backed up, so I figured I couldn't do anything too bad.
I then ran through the buttons, activating all of them:
* Fix Script Instances
* Delete all #
* Clean other
* Del. broken activities
* Advanced - then select both buttons - Remove scripts attached to nonexistent created forms and Remove scripts having invalid variables
*Mod editor - Selected All - then unchecked Skyrim.esm, Update.esm, Dawnguard.esm, HearthFires.esm and Dragonborn.esm (00 to 04) - then click the button delete slected mods forms and Delete Selected mods scripts. At the bottom of this same screen I then clicked Delete Created Forms (FF) and Delete Created Scripts (FF)
*Back on the main screen, click Clean formlists
*Reset havok
I then repeated the first 4 steps again - a couple of new things were deleted that did not show up the first time through.
I then saved it as edited save and loaded it up.
All the scripts had to re-load and the script settings were reset to default - not a big problem.
I then went and belted a guard over the head. He pulled his shield out properly.
I then reloaded, and it worked again.
I then fast travelled to a different city, and tried a different guard. It worked again.
Sometimes, they'd try draw it two or three times, which I think is a different (maybe vanilla) bug - but they got it out and started fighting like normal. Loop fixed.
For now.
Hope it works for you guys. I spent ages searching forums and came up with nothing.
