Daedra and Aedra do not really have dibs on dragon souls. I would say that Dragonborn could go and and say "Sure, you can have my damn soul" for every creature in the existence.
And at the top of it, active Dragonborn should have plenty of souls to spare, if someone actually is bold enough to come asking for it, when Sithis and Akatosh are looming around. I mean, how many dragon souls did you devour during the campaign?
You're supposed to role-play in this game. If we're going lore-wise, is the LDB really a master of all factions, wielder of all daedric artefacts and master of all trades, like some folk imagine it to be? Handing out soul contracts like pieces of candy? It's all optional, excluding Mora's claim.
The conjecture that an omnipotent daedra from above who can watch anyone anytime, is unaware who they're dealing with is far fetched. We are even given explicit hints that Daedra know who Dragonborn is, Clavicus Vile claims that LDB is as powerful as him without Barbas. Mora directly refers to LDB by his title.
Akatosh doesn't claim dragonborn's or dragons souls.. Go to Sovngarde's halls, there are dragonborns roaming around. Dragon's souls reside in their bodies unless absorbed. If you sign a binding oath to Nocturnal or the Eternal Masters, that's it, game over.
Dragonborns are born with dragon blood and soul, but in human form. Their bodies are mortal, bu their souls are immortal. There isn't a single record that any Daedra would have ever managed to claim a Dragonborn soul.
Only ones to be able to claim such souls would be Akatosh or Sithis.
There are no known Dragonborns in Sovngarde. Not one.
The ability shout has nothing to do with being a Dragonborn. Anyone can learn that talent, giving that they have enough patience to learn. Even Ulfric can shout. He learned the talent by studying with Greybeards, not by being born with it.
Those two had a deal for a long time. I am unsure if HM actually claimed Miraak. It was Last Dragonborn who devoured his soul.
But since you follow him and absorb him it becomes academical. But then HM seems to be claiming you as his champion as well, so it could be you are going to be bound to him...
But Bethesda never clarifies anything, so it's kind of pointless to speculate.
Still doesn't matter. If you do ANY Daedric quest, that Daedric prince basically says that they own you. Whether they do or not has no bearing on the matter. If ANY of the et'Ada could be said to have a claim on the Dragonborn's soul, it would be Akatosh. That's been part of being Dragonborn as far back St. Alessia in the First Era.
Like Ilja said, being able to use the Thu'um isn't what qualifies you as a Dragonborn. Be definition, Dragonborns are mortals who are born with a dragon's soul. THAT'S what qualifies someone as a Dragonborn, not being able to Shout. ANYONE can use the Thu'um with the proper training, it's just that Dragonborns instantly gain the training and knowledge through the absorbtion of dragon souls, while everyone else has to do it through endless practice.
My point was solely that Miraak seemed to be confirming that HM had claimed him utterly.
Whether their souls are of dragon origin or immortal is irrelevant here as I've emphasized earlier. And yes there is no record, maybe it having to do with the fact that the few Dragonborn's were mostly humans and humans generally don't like worshipping/dealing with Daedra? There is also no records of Akatosh claiming Dragonborn's souls so it goes both ways.
Yes there are Dragonborns there, I guess such an oversight can lend to making wrong conclusions. Here's a dialogue you can get when interacting with a generic "hero of sovngarde"
"Hail, Dragonborn. That honor is also mine - to our shared birthright you'll bring new glory!"
What does that tell us? That basically it's filled with all sorts of heroes, dragonborns among them. And by birthright, they all can go to Sovngarde just like LDB.
How can you be unsure of that? The whole dialogue is centered around Miraak being enslaved to Mora both from Mora's and Miraak's perspective.. It's a classic example of a Dragonborn dealing with daedra and becoming their prisoner in their dimension. The only difference being Mora does not ask consent or emphasize serving him in the afterlife as Nocturnal does.
Not one of those characters are listed or recognized as Dragonborn. Not even by Bethesda. The greeting stands for Nord's right enter in to Sovengard, if they died at suitable conditions.
Go ahead and name even one character that has been officially recognized as Dragonborn. Even Tsun states that he has not seen one in ages.
Because Last Dragonborn devoured Miraak's soul. He might have been HM's toy, but where it is stated that he got Miraak's soul after he was killed and devoured by the protagonist?

You are coping so hard here, Nords don't have the birth right to enter Sovngarde, only those who prove their mettle in battle. That's the lore. On the contrary Dragonborns can go there by birthright this is also explicitly stated by Tsun. Read the quote again carefully, pay emphasis to "that honor is also mine" "to our shared birthright you'll bring glory"
Those are unnamed Dragonborns you meet in Sovngarde, it's a generally agreed upon fact.
If we also go by what Tsun says to LDB, him serving Sithis doesn't stop him from going to Sovngarde, however by death their contract binds them to Nocturnal.
Maybe it having to do with the fact that Mora said he doesn't want Miraak anymore and Miraak said he was betrayed? Also, pay attention how I've said that Mora doesn't emphasize servitude in the afterlife. A daedra can imprison you for eternity in their own dimension if they wish so during your mortal life. By your logic we could even contend that you're not absorbing Miraak, but the dragons that he absorbed. Unless you're telling me that a mortal like LDB has first dibs on dragonborn's souls over Akatosh?

And for your last part: there are still no records of any Dragonborn serving Daedra in after life. HM did pull Miraaks strings, true. And yet we still do not have proof that he could have taken his soul. In the end, it didn't even matter, when DB devoured the soul.
