You need the USLEEP (the Unofficial patch) - https://www.nexusmods.com/skyrim/mods/71214
This is just one of the literally thousands of bugs which the Unofficial patch fixes (though, keep in mind, that some bugs cannot be fixed retroactively, but will require you to go back to a save made before the bugged event was triggered - or start a new game).

I've done quite a bit since i've married Derkethus, so I won't have the option to reload back before I married him. I'm wondering if I have the option to remarry him if I install the skyrim divorce mod and divorce him and if that will fix the bug.
