Your previous equipment simply has a better "legendary" rating.
I suspect that's the problem. I'm guessing the OP has the perk for Elven smithing, but not for Dragon smithing. If so, the elven perk gives 2x better tempering and the Dragon smithing gives the default tempering.
That said either one improved to legendary should be hitting the armour cap, unless you have a mod that uncaps the armour rating.
Not sure why the improved Dragonscale armour is inferior to Elven... I know some weapons are better at the previous tier, but not armour.
You don't need a perk to get up to legendary quality.

Level 1 game, gaining experience was allowed, just not using it so no perks whatsoever.
-Level 100 smithing
-Daedric gloves 25% smithing
-Silver Blood Ring 15% smithing
-Armor with 14% smithing
-Amulet with 14% smithing
-Notched pickaxe for +5 Smithing skill
-Book of Sallow Regent 10% boost
-Blacksmith's elixir 50%
And this was allready overkill for getting "legendary" quality
