Fist fights broken?

I played roughly 400 hours in the game and this issue never happend before.
I installed the game again because i recently purchased dragonborn, installing an updated blood graphical mod and playing in higher difficulty were the only changed I made to the game.

The issue is that every time I start a fist fight (for quest/cash/follower/whatever) after a few seconds the enemy suddenly draws their weapon, and the fight seems to change from fist fight to normal combat (I can draw weapons too, and I don't get a bounty if it ends in killing), but when the enemy yields and the fight seems to be won, they don't concede their loss, thus I lose the gold (if I bet), and get no follower, or can't progress in quests with fistfights (in markarth i had to pickocket the letter from the guy who comes to beat you in the forsworn conspiracy quest).

I thought that maybe its related to difficulty level, but even when i lowered it the enemy still draws weapons... wtf?
