If I steal a horse from the bandits does it still count as stealing?

Yes unfotrunately... I don't know if you would get a bounty if bandits saw you do it.

Yep and guards in that hold would chase you for that bounty .... unless all witnesses are killed of course! ( including any chickens that witnessed that!)

You will get a message on screen if a bounty is cleared by killing all witnesses.

Stealing a horse doesn't really help you as it will just walk away from you once you leave it's vicinity and you cannot sell the horse ... unless you find a mod

You could try changing the ownership of the horse with console commands, but i dont know if you should...

If you haven't before, I recommend the Immersive Horses mod. It allows you to adopt a horse after you steal/ride to another location and dismount there. That location becomes the default "home" when you dismiss your horse.

Thanks to IH, I always steal/adopt the horse at Smuggler's Den right away so I can have someone to carry all my crap before I buy a house.

I always get the free horse north of Snow Veil Sanctum. It is a former hunters horse, in their camp with the hunters bodies a couple hundred meteres east. The horse never wanders away. It is the only truly free horse in the vanilla game.
