I think the end of Eli's second side story you pretty much just defeat him, so it doesn't matter if you killed him, captured him, dipped him in a shark tank etc. There are two third missions that will show up "Kill" or "Recruit". It is possible you are not far enough in the story. Progress the main story a little and see if it appears.
The only Henchman quests where you would get locked out is if the final mission says "Kill or recruit" and the boss comes to your lair with a big "kill or capture" icon on them, and you kill them instead of capture. Bosses like this wander around your base as an NPC until you do their third mission. This isn't the case with Eli, so you should be good. Again, just make sure you have an open henchman slot.
I was worried because I am playing through with Ivan on Hard and Jubei and Eli are needed for an achievement. I am very early on in the game and only have 1 henchman (Iris) at the moment so it must be that I haven't gotten far enough in the main story line.
When the only option I had in "With an Iron Fist" was to terminate Eli I was worried that I screwed something up. I have only played Max on Hard before and only tried Jubei. I ended up killing Jubei because I didn't realize there were 2 versions of the final quest, I thought it would give me the option at the end.
