That's an interesting question!
No legal setup of that kind was undertaken for Asteroids Millennium. While I'm not overly familiar with copyright law, my understanding is that game mechanics ideas themselves are non-copyrightable --- specific expressions of such ideas are, but the way Asteroids Millennium expresses such mechanics are obviously different from how Asteroids does.
Also, given the number of similar games on Steam containing the word "Asteroid[s]", I wasn't too worried about the name, either, and assumed it was safe to use that word in a title.
Are you planning on developing and releasing an Asteroids clone? :)
