If that's not your issue, it may be some other mod has set Tullius to Essential or Protected, in which case I think that can be fixed with console commands, maybe...
EDIT: If you want to set him to non-essential the command is as follows:
setessential <base ID of the NPC> <1 (immortal) / 0 (mortal)>
I hear this can break quests though, so if it's a mod doing it, you should try to pinpoint that mod first, console command as last resort.

The command goes into console - you'll have to do it from the PC screen.
Press the tilde key (~) next to the 1 key. If you've never used console commands before, the info I provided above might look confusing, so here's a step-by-step:
Make sure you hard save before doing any of this, if you can.
1. Press the tilde (~) key
2. Type setessential 0001327E 0
3. Press Enter
4. Press tilde key again to exit out of console
5. Resume playing
