Youtube, let's play, music copyright, monetization issue?
So I recorder my first video from the game, with my voice, of course, and as soon as it uploaded I got a notice from WMG that I won't be able to earn anything because there is copyrighted music in my video. I couldn't find the answer in eula, so I'm asking here. Come on, youtube gaming is the majority of uploaded content, and people are making their living from it, so what's the matter here?

The matter is that Youtube's algorithms pick up on copyrighted music automatically. It's not something the developers can specifically control. You can submit an appeal arguing that your video is covered under fair use policy, but it's tricky with things like let's plays because it depends on whether your video transforms the original whatsoever.

Because it's an automated system, it's next to impossible to avoid being flagged- anything above 20 seconds of audio usually gets caught and monetisation is disabled.

If it will tell you specifically WHAT part was claimed on, so you know which song it is, you can disable music in the audio settings menu and replay and rerecord that part.

I wanted to try, but YT FAQ is so unclear about the fair use so I didn't want to risk deleting the video (not that I couldn't upload it again)

They claimed two songs, but I wasn't able to check both (no time, had to sleep) and specified the exact moment when they're playing. Still, it's not like I downloaded the song and pasted it into Sony Vegas, it is part of the game.

In the credits at the end of the first episode I'm pretty sure I read that the music is copyrighted by Universal Music.

Yeah, I tried uploading the end scene of the game and got a copyright strike for music from UMG I believe it was. So I obviously had to take it down. Really wish I didn't have to cause that scene was incredible and there's not much people who uploaded that scene

Yes that would be Universal Music Group.

I took the risk and made a complain. I brought up the argument that these songs are part of the game and I didn't use them there on purpose. Well, we'll see.

I'm sorry but I also want to make my own youtube channel. I thought you need the permission from square enix to upload it on youtube, or am I wrong?

Thank you for your help and have a nice day!

Look at youtube and think how many of them actually have permission. I'd say less than 5%. Why? Because there is a thing called Youtube Gaming, also, many developers encourage gamers to publish footage from thier games, it's basically free advertisement. Only copyright claims I got were for the ingame music.

the matter is that people made poor life choices and actually depend on videos on youtube instead of getting a real job.

Hate to break it to you, and I know this won't get through your head, but it is a real job.

I remember last year that the videogame Alan Wake was being removed from digital stores like Steam, due to expiring music licenses.

So maybe LiS and LiS: BtS are going to face same problems in some few years.

Only Square Enix Music: Some of our games contain music that we don’t own and merely license. Usually you’ll be able to recognize this (such as the radio music in Sleeping Dogs), but we understand it won’t always be clear. As a result, your video could be subject to automated filtering by the owner of the recording or composition. If you’re unsure about a particular song, please check the game credits. Since we cannot grant you a license to use someone else’s music, you’ll need to get permission from the copyright owner(s).

Sorry we can't help with this, much as we would love to." -Inexorabilis (Community Manager for Square Enix Europe and Life is Strange.)
