Establishing company under laissez-faire

I am trying to form Suez company, the tooltip says i need 5 "buildings", i have 5 regular shipyards there, but they are government owned.
I had similar problems before and to my understanding, the way it is coded, that under laissez-faire you can only buy levels to form a company, but you cant use government owned levels, thus i have to wait to sell those shipyards and only then i can buy them back to form a company.
Am i correct?
