Also how much higher is your skill since the last time you upgraded? You need a minimum skill with or without the perks to reach the next tempering "tier" It doesn't mean you can temper somthing twice.
It is based on your smithing skill not your level.
Also OP if you previously used smithing gear/potions to boost the skill level and you are not doing that now you might actually have lower skill this time around than you did before.
That depends on mods really I can name a few mods that alter those requirements. I mean I know mods were you need certain perks.
Scenario 1: If the second upgrade does not make enough of a difference then the game won't allow you to do it, it needs to reach a new threshold (from Flawless to Epic for example). That said, there are thresholds after legendary that does not have a name (With enough boosts you can upgrade a legendary item further but it will still have the legendary quality/title/whatever).
Scenario 2: If you enchanted the item and do not have the perk that allows you to upgrade enchanted equipment then the game will not allow you to do it (The perk is called "Arcane Blacksmith: You can improve magical weapons and armor"). You can upgrade items and then enchant them without that perk, but not upgrade already enchanted equipment.
I should have been clearer "your current smithing level" is what i was intending.
As I stated in my original post that perk does NOT mean you can temper somthing twice. All it does is essentially double your smithing skill when you do improve that item. You need to increase your skill some more on order to make the weapon stronger.
And without mods or exploits you won't be able to improve it past a certain point anyway; don't remember exactly where the cutoff is but I remember Dwarven swords being able to be improved well past Steel with identical perks and smithing skill.
Weapons can be improved to "Flawless" without perks and "Legendary" with them. It depends entirely on your skill of course but both steel and dwarven can be brought to that quality however dwarven has a higher base damage so it might seem better but in reality that is just because the weapon is of a higher tier not because you can improve it further. That being said you DO need better smithing to work with dwarven material which may also factor into that.
