No, the "be understanding" excuse stops working the moment you accept money from people.
The developers stole code, the lead developer has done this before, there is no misunderstanding here.
They took money from people via Patreon, incurring a moral and ethic debt, when things went bad they tried to ignore said debt via an open letter.
They have taken the moral low ground time and time again, this is indefensible.
If they turn over a new leaf, and start stop taking quickcuts while trying to look down upon their potential customer base, then we will reconsider. But until then we ARE understanding, and what we are understanding is they have the morals and ethics of a cat.

Ok first things first ... if you think this is "WW(3)" or even close to it, you've lived a life that has been far too sheltered to prepare you to be able to survive in the real world.
Secondly, scummy behavior shouldn't just be ignored, and the devs have proven themselves to be scummy; even if you believe the stolen code was a "mistake", the rant "harmless venting", and raking in thousands upon thousands of dollars in cash with very little to show to it isn't a scam; well, your argument of "ignoring something you dislike" does not apply to your post why exactly?
There are no victimless crimes.
It's a repeat crime for some of the devs.
I don't know how to dumb it down any further, or want to.

Yet again, you are completely incorrect but state your incomplete knowledge as fact. Then you even have the gall to declare that other people need to do their research first. Why are you still claiming that the SKSE team never got back to the ST team when it's well documented that they did get back to them and said no? There was even a standing clause in the terms that the lead dev couldn't use SKSE assets before the ST team even asked.
