Killing the Thalmor and freeing the prisoner
So if you kill the thalmor and free the prisoner on the road, who is there to be a witness against you for killing the thalmor and freeing the prisoner? The prisoner you freed is a witness against you? That hardly seems right..

If you attacked the Thalmor before they started attacking you there would be witnesses. Such as the wildlife, as mentioned above. Free the prisoner first, then the Thalmor will attack you first. So, there won't be any witnesses if it's done that way.

Maybe, but in that case it's the prisoner himself. Once during Diplomatic Immunity qust Malborn and that prisoner guy reported on me for being in werevolf form, despite the fact that I saved their lives. That's just how this game works.

P.S. Best way to free prisoner on the road if you are Nord or Imperial: free him, give weapon, use racial power (Voice of the Emperor or Battle Cry). Done!

Activate the prisoner and choose to release him.
Now you won't get a bounty from killing the Thalmor since they attacked first.
