Well, it is the act of bypassing any restrictions to download content, which means, yes, illegal content gets torrented.
That depends on in which country you live.
The big problem is so many have used it for illegal downloads torrenting has a bad name. Once upon a time, if you wanted a mod for a game that was over 100MB, you grabbed it through bit torrent.

Yeah, they did have different download links in TWC, but all those sites were taken down, and now Torrent in TWC is only "official" way to get it.
So, as a general rule, if the links are dead, avoid!
As for torrents itself, as far as I know, the downloading isn't the illegal part, it's the uploading, atleast where I live.
