Game racks up playtime in the background?(SD)

Bought this to play on my Steam Deck.
Played about 1 to 2h total, got bored and went for a refund.

Noticed the game counted up to a whopping 11 HOURS??

Either the ubisoft launcher stays enabled in the background and continues counting playtime or the game somehow keeps counting when the SD is in sleep mode.

Does this actually make my refund invalid?
If yes, is that even legal?
Having a third party launcher that continues to count as playtime after closing the game and is virtually invisible on the steam deck?
