Yes, this applies to most heroic familiars where the taming conditions are unmet while having the mark. When you have the mark and the conditions are not met, its just a matter of bringing its HP as low as possible.
You might even be able to tame it at 50% health or more, but lowering its health always helps in taming, or you must have some very bad luck, be sure to have taming pots, rings and possibly gear with taming bonusses to help you out.

You get them for free as a subscriber, you may also buy them for Elune from the Elune market place.
In the market place under "Buff" you can find them, called Taming Succes Booster. (3 Elune, 10% extra taming chance).
