Considering you're threatening legal action? Consider this: many customer service/tech support environments will consider "I'm gonna sue" as grounds to immediately transfer you to the legal department, which means they won't be able help you fix the actual issue any time soon.

And was there download failure?
That usually means that your Internet connection is not stable (either in general, or just between you and the server) and you probably should complain to your ISP.
If you don't have access to a more stable connection, you'll need to use a download manager to resume an interrupted download -- if it works for that particular download (depending on how it was implemented, maybe it won't).
Edit: Actually, suing Steam is the mistake since they technically not at fault. The developer/publisher of the game is the one you want to go after. Yes, Steam should offer a refund to all affected users but they'd eat a possible hefty loss since I doubt they can get that money from the dev/publisher themselves. So yeah, f*** that dev/publisher of that s***ty "game".
