To find them for sale you will need a combat reputation of admiral, and hope they appear for sale in a port that has a shipwright. You will generally find 1st rates in ports originally owned by France, England, or the Netherlands and galleons can be found in ports originally owned by Spain. Note that the current controlling faction does not determine ship availibility.
Alternatively, you can attempt to capture one from a faction officer. Use non-solid grapeshot to eliminate their crew and party, and be careful of any other ships they may have in their fleet. Be aware there is currently a bug with capturing top tier ships that causes party vessels to disappear if you do not already have one in your fleet.

Thank you very much for this much needed reply. I'll surely have a couple 1st rates by the time I reach admiralty.
I use manilas for my cargo and first rates for my combat. Just my own personal preference. 32+ speed first rates are funny though.
