A lot of people are surprised by this because the Larian CEO Swen Vincke praised the work that went into the mod. But WotC are the license holders, so to speak.

I so hope that WOTC is approving it. The crossover is sooo amazing! It's such a pity that I didn't find this mod sooner so I'd be able to play it. Fingers crossed :)
According to WotC the DMCA strike was issued by mistake. Something I find really hard to believe. I think they just couldn't deal with the backlash but who cares, it's back
sad thing is the baldurs gate name, characters involved and location is something wotc owns/control to their pleasure and not creative freedom like ogl 1.0. hence baldurs gate being a licensed thing and also why larian, devs of baldurs gate 3, isnt doing new major locations, characters and such because of license issues by wotc. they can still add classes and such but basically they cant make or expand on characters since that fuels wotc control and monetized gain.
if ppl are like whatever then here is something to anger a certain fandom: astarion is basically wotc b$^@h in a bad, non consensual way. they own him and can do whatever they want with him in books, other media and such that can be damning to his character that larian established. so worst cast wotc say keep stardew mod but they want astarion removed or else.

But it's a free mod, which falls under fair-use does it not? It's like people who make trans/queer fan-fics of the Harry Potter characters. JKR can't do anything about it. Also, even if it was sold, just using the characters does not break copyright law; there are cases where commercially sold art was found to not break copyright law even though it significantly referenced the source material BUT was still considered transformative -- ANYWAYS. To be clear, I haven't played the mod, but if the characters have their own new story, stylistically different, original scenes, etc, it would definitely be considered transformative. Moreover, Astarion is just a character in the BG3 universe. A beloved one, but not the main character nor the character where the entire plot is built around. They'd have a better case if the mod referenced the main storyline of BG3 itself significantly. He is also stylistically different, so aside from name & having some physical similarities, he could be considered a different character. Lastly, for it to be infringement the mod and use of Astarion's likeness would've had to actually cause financial harm/loss, taken away meaningful opportunities for them to make money, OR there would have to be a presumption that using copyright material like this could harm the market as a whole. In general, modding is free and considered additive as long as it doesn't give away product that belongs to the original creator and was put behind a paywall by them. Putting characters into other completely different games not owned by the original creator is really only done by modders for free -- due to companies being greedy about who gets what from sales, or who then owns the newly generated material. So WOTC wouldn't have a strong case in suggesting that this mod or inclusion of Astarion harmed them in anyway....which is likely why they dropped the case. They know gamers are already mad at them due to Larian's exposing their greed & actively trying to make BG3 a sh*ty cash grab, and frankly they don't have money to waste on frivolous lawsuits that are just going to destroy their reputation further even if they win.
