Besides, pretty sure you can alter the key bindings in the ini file, i appreciate that's not the perfect solution it is however, a solution to the problem which, means it can be sorted with relative ease.
Fixed this issue with tweaking User.ini file, located in %APPDATA%\BioshockHD\Bioshock\, simply clearing all button bindings in lines starting with "XENON". Hope this will help somebody, as the recent patch did not fix this issue.

SO for the win.
XENON_START corresponds to the volume down key
XENON_BACK corresponds to the volume up key
So open user.ini in Notepad and do a find & replace:
"XENON_START=PauseGameAlias" to "XENON_START="
"XENON_BACK=ShowContextHelp" to "XENON_BACK="
This fixed the volume key issue for me.
Edit: This applies to BioShock 1, I haven't got to 2 yet. It sounds like they're set up the same though.
OMG bro you're my hero! It was driving me NUTS that the only way to properly change my volume was through the Shift+Tab menu, I was about to buy a separate keyboard (and wind in the same problem). This saved me from a whole lot of trouble
