since there has been already a full-fledged horror game in its own right made about him and there are also countless alt. reality stories, e.g. Marble Hornets, I don't think licensing would be a problem
But the fact that there's already a horrorgame about him might make the Devs not want to add him (him being cliche would most likely not figure into it because Myers is a ♥♥♥♥♥♥♥ joke on youtube with all those parodies)
Theoretically, if DBD used creepypasta content, and the person who created said creepypasta objected to it, they could sue the DBD devs... but without legal proof of ownership and no budget to hire lawyers and make aggressive court actions, they would almost certainly lose.
